Privacy notice

Who we are

Elekeza Digital is a web and design studio in Nairobi, Kenya. We are responsible for the personal data collected through www.elekezadigital.com (the "data controller" under the Act).

For any question about your data, email elekezadigital@gmail.com or call 0757 770 889.

What we collect

When you send the quote form

Your name and phone or WhatsApp number, which are required, and anything else you choose to add: your business or organisation, email address, the service you need, when you need it, and your message.

When you contact us directly

Whatever you send us by phone, WhatsApp or email.

Analytics, only if you accept

If you click Accept on the analytics banner, Google Analytics records which pages you visit, roughly where you are (to city level), your device and browser, and how you reached the site. It uses cookies named _ga and _ga_ followed by an ID. If you click Decline, or ignore the banner, Google Analytics does not load and sets no cookies.

Spam protection

When you send the form, a scrambled (hashed) copy of your internet address is kept for about an hour in a small database run by Upstash. It is used only to limit each connection to five messages an hour, and it is not linked to your name or message.

Server logs

Like most websites, our hosting provider, Vercel, keeps standard request logs, such as internet address, page requested and time. These are used to keep the site secure and working.

Why we use it

• To reply to your enquiry and prepare a quote. You asked us to, and it is a step before any agreement between us.
• To understand how the site is used. Only with your consent, which you can withdraw at any time.
• To keep the site secure and free of spam. This is in our legitimate interest and yours.

We do not sell your personal data, use it for advertising, or add you to a mailing list.

Who else handles it

• Vercel hosts this website and runs the quote form.
• Google provides the email service that delivers form messages to our inbox (Gmail), and Google Analytics if you accept it.
• Upstash holds the short-lived spam protection record described above.
• Meta runs WhatsApp. If you message us on WhatsApp, WhatsApp's own privacy policy applies to that conversation.

Vercel, Upstash and Google may store and process data outside Kenya. We use these services under their standard data protection terms.

How long we keep it

• Enquiries that do not become a project: up to 12 months after our last contact, then deleted.
• Records for clients we work with: as long as the work requires and the law requires for business and tax records.
• Analytics data: 2 months, the Google Analytics default.
• The spam protection record of your internet address: about one hour.
• Your analytics choice: stored in your own browser until you clear it.

Your rights

Under the Data Protection Act you have the right to:

• be told how your personal data is used, which is what this notice is for
• see the personal data we hold about you
• have data that is wrong or misleading corrected
• have your data deleted
• object to us using your data
• withdraw your consent to analytics at any time
• receive your data in a format you can take elsewhere

To use any of these rights, email elekezadigital@gmail.com. We will reply within the time the law allows.

If you are not happy with how we handle your data, you can complain to the Office of the Data Protection Commissioner at www.odpc.go.ke (opens in a new tab).

Cookies and your choices

The only cookies this site uses are the Google Analytics cookies described above, and only after you accept. Your Accept or Decline choice is saved in your browser's storage, not in a cookie. To change it, use "Analytics settings" at the bottom of any page.

Children

This site is for businesses, organisations and adults looking for web and design work. We do not knowingly collect personal data from children.

Changes to this notice

If we change how we handle personal data, we will update this page and the date at the top.
